Terms of Service — GoWai Gaming

These Terms of Service (“Terms”) govern your use of Android games and related services published by GoWai Gaming (“we”, “our”, “us”) on Google Play (together, the “Games”). By downloading, installing, or playing any of our Games, you agree to these Terms. If you do not agree, do not use the Games.

1. Who we are

GoWai Gaming publishes free-to-play mobile games on Google Play.

2. Eligibility

You must be able to form a binding agreement under the laws of your country. If you are under the age of digital consent in your country, you may use the Games only with a parent or guardian’s permission. Our Games are general-audience titles and are not directed at children under 13.

3. Licence to use the Games

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the Games on devices you own or control, solely for personal, non-commercial entertainment.

You may not:

  • copy, modify, distribute, sell, lease, or reverse engineer the Games, except as allowed by applicable law

  • cheat, exploit bugs, use unauthorised third-party tools, or interfere with the Games or other players

  • remove copyright, trademark, or other notices

  • use the Games for any unlawful purpose

All rights not expressly granted remain with GoWai Gaming and our licensors.

4. Free-to-play, ads, and in-app purchases

Our Games may be free to download and may include:

  • advertisements (including interstitial and rewarded ads)

  • optional in-app purchases for digital items or features (for example hint packs or ad-free unlocks)

Purchases are processed by Google Play under Google’s terms and payment policies. Prices and availability may change. Digital purchases are generally non-refundable except where required by law or by Google’s refund policies. We do not receive your full payment card details.

Virtual items and progress have no real-world cash value, are licensed (not sold) to you, and may be modified, reset, or discontinued.

5. Accounts and local progress

Unless a specific Game states otherwise, you do not need to create an account with us. Progress and settings are typically stored on your device. Clearing app data, changing devices, or uninstalling may result in loss of progress. We are not responsible for lost local progress except where required by law.

6. Privacy

7. Acceptable use

You agree not to misuse the Games or our services, including by attempting to disrupt servers or networks, scraping or automated access where not permitted, or uploading harmful content if a Game ever allows user submissions.

8. Updates and availability

We may update, change, suspend, or discontinue Games or features at any time. Some updates may be required to continue playing. Games depend on Google Play and third-party services; availability may vary by region and device.

9. Intellectual property

The Games, including artwork, audio, text, code, names, and logos, are owned by GoWai Gaming or our licensors and are protected by intellectual property laws. These Terms do not transfer ownership to you.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Games are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Games will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

To the maximum extent permitted by law, GoWai Gaming and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Games.

Our total liability for any claim relating to a Game will not exceed the greater of (a) the amount you paid us for in-app purchases in that Game in the 12 months before the claim, or (b) £10, except where liability cannot be limited by law (including for death or personal injury caused by negligence, or fraud).

Nothing in these Terms excludes rights you have as a consumer under UK or other applicable law that cannot be waived.

12. Indemnity

You agree to indemnify and hold GoWai Gaming harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Games or breach of these Terms, to the extent permitted by law.

13. Termination

Your licence ends if you stop using the Games or if we terminate access for breach of these Terms or for operational or legal reasons. Sections that by nature should survive (including intellectual property, disclaimers, liability limits, and governing law) will survive termination.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Games after changes means you accept the updated Terms, except where applicable law requires a different process.

15. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer you may also have rights to bring proceedings in your country of residence where required by law.
